OverviewRecycling of Electronic Waste
Electronic waste is a growing environmental concern. Individual states within the United States have recently enacted legislation to address this issue, and Fujitsu is actively complying with the varied requirements.
California
California e-waste law took effect on January 1, 2005, and requires charging customers a fee at the time of purchase to cover recycling of certain electronics products at the end of the product's useful life.
Under the California Electronic Waste Recycling Act of 2003 (known as SB20), retailers selling certain electronic products (including the Fujitsu Direct Store) must now collect a recycling fee from California consumers at the time of purchase. This fee will automatically be added to the shopping cart when checking out for applicable products being sold to California consumers. This fee is used to foster the development of recycling opportunities and offsetting the cost of properly managing these types of products at the end of their useful lives. Connecticut
In July of 2007, the State of Connecticut was one of the first in a growing list of states that adopted a law concerning the recycling of household electronic waste (e-waste). This law enables Connecticut to better manage an ever-growing portion of the solid waste stream. Under this e-waste law, residents will have convenient and free opportunities to recycle their computers, printers, televisions and monitors; and manufacturers will finance the transportation and recycling of them. Retailers will be required to inform their customers about electronics recycling options, and will only be allowed to sell these products from manufacturers that have registered with the Department of Environmental Protection (DEP). Hawaii
The Hawaii Electronic Waste and Television Recycling and Recovery Law requires manufacturers of covered electronic devices (CEDs) and televisions to operate recycling programs. Illinois
Public Act 95-0959 became the law of the State of Illinois in September 2008. The law establishes a statewide system for recycling and reusing computers, monitors, televisions, and printers discarded from residences by requiring electronic manufacturers and retailers to participate in the management of discarded and unwanted electronic products. Indiana
Effective July 1, 2009, the Indiana Legislature enacted the Indiana Electronic Waste Program (IC 13-20.5). The purpose of the program is to reduce the amount of electronic waste being sent to Indiana landfills and ensure that hazardous substances found in electronic waste are being managed in an appropriate and environmentally responsible manner. Maine
In the Spring of 2004, Maine passed a new lawAn Act to Protect the Public Health and the Environment by Providing for a System of Shared Responsibility for the Safe Collection and Recycling of Electronic Waste, (38 MRSA §1610). This law has provisions that apply to Maine municipalities as part of their MSW management responsibilities. The Maine Department of Environmental Protection (MEDEP) created this guide to provide municipalities with the information from this law that is relevant to them. Maryland
The Statewide Electronics Recycling Program (Environment Article, Title 9 Water, Ice and Sanitary Facilities, Subtitle 17 Office of Recycling, Part IV Statewide Electronics Recycling Program) becomes effective on October 1, 2007. The law requires certain electronic manufacturers to register with the Maryland Department of the Environment and pay a registration fee if they intend to sell covered electronic devices in Maryland on or after January 1, 2008. Michigan
The Electronic Waste Take back Program was established in 2008 as part of a law promoting electronic waste recycling. The law requires: Manufacturers who are selling new TVs and computers in Michigan must, Register with the Department of Natural Resources and Environment , Have an electronic recycling (take back) program-free and convenient for households and small businesses (less than 10 employees) , Maintain a Web site and otherwise inform consumers how to recycle TVs and computers , Submit annual information about their take back program (number of units collected, names of collection or recycling agencies involved) More information about Electronic Waste Recycling: http://www.michigan.gov/deq/0,1607,7-135-3585_4130_18096---,00.html
Minnesota
In May 2007, Governor Pawlenty signed this new law for the collection and recycling of "video display devices" sold to households and consumers, including televisions, computer monitors, and laptop computers, and additional devices which meet the definition. Manufacturers of video display devices (VDD) must annually register and pay a fee to the state, collect and recycle "covered electronic devices" (CED) from households and consumers in Minnesota, and file a report detailing the results of their collections for each program year. Missouri
Senate Bill 720, part of which is also known as the “Manufacturer Responsibility and Consumer Convenience Equipment Collection and Recovery Act,” was signed into law with an effective date of August 28, 2008. This law requires manufacturers of computers to implement "recovery plans" for the collection of and the recycling or reuse of their obsolete equipment. New Jersey
The “Electronic Waste Management Act” P.L. 2007, c.347 as amended by P.L. 2008 c.130 (N.J.S.A. 13:1E-99.94 et seq.) and signed into law January 2009. New York
The NYS Electronic Equipment Recycling and Reuse Act (39 kB) (Article 27, Title 26 of the Environmental Conservation Law) was signed into law by the Governor on May 28, 2010. The law will ensure that every New Yorker will have the opportunity to recycle their electronic waste in an environmentally responsible manner. The law requires manufacturers to establish a convenient system for the collection, handling, and recycling or reuse of electronic waste. Manufacturers of covered electronic equipment (CEE) will be responsible for implementing and maintaining an acceptance program for the discarded electronic waste, with oversight by the NYS Department of Environmental Conservation (Department). North Carolina

Oklahoma
Signed into law on May 13, 2008 The Oklahoma Computer Recovery act establishes a convenient and environmentally sound recovery program for the collection, recycling and reuse of computers and computer monitors that have reached the end of their useful lives. Oregon
Law passed in 2007 requires manufacturers of desktops, laptops, monitors, and TVs to participate in a recycling plan or pay a fee to the State Contractor program. Pennsylvania
Beginning Jan. 24, 2013, desktop computers, laptop computers, computer monitors, computer peripherals, televisions, and any components of such devices may no longer be disposed in Pennsylvania with municipal waste. Additionally, covered devices that are not from an occupant of a single detached dwelling unit or a single unit of a multiple dwelling unit that used a covered device primarily for personal or small business may no longer dispose of these devices or their components at that time. Rhode Island
Signed in June of 2008, manufacturers of electronic products have individual financial responsibility to take back and recycle their products at the end of the product's useful life from both households and public/private elementary & secondary schools. This law will help the State of Rhode Island better manage an increasing portion of its solid waste stream. Texas
The Texas Computer Recycling Program requires manufacturers who offer to sell new computer equipment in Texas to provide a program for collecting and recycling consumers’ used computer equipment, free of charge to the consumer at the time of recycling. Utah
On March 22, 2011, Utah became the twenty-fifth state to enact product take-back legislation for electronic products with the passage of Senate Bill 184, regarding the Disposal of Electronic Waste. The law imposes reporting and public education obligations on manufacturers beginning July 1, 2011.
Vermont
The new electronic waste law will ban the disposal of electronic waste starting January 1, 2011 and will provide convenient collection of certain electronic waste for consumers, charities, school districts, and small businesses for free starting July 1, 2011. Virginia
Legislation was passed in 2008 to require a computer manufacturer that in any calendar year manufactured or had manufactured computer equipment in excess of 500 units which were sold (or offered for sale) in Virginia under its brand or license to implement a recovery/recycling plan for those computers at no charge to the consumer. Information on the legislation, and its requirements on computer manufacturers, can be found beginning at Section 10.1-1425.27 and continuing through Section 10.1-1425.38 of the Code of Virginia. The Act goes into effect July 1, 2009. Each manufacturer must file its recovery plan with DEQ in order to continue to sell its products in Virginia after the effective date of the legislation. If a manufacturer's recovery plan is not in place (and on file with the Department of Environmental Quality) by that date, the manufacturer's computers can not be sold in the state. Washington
Law signed in March 2006 requires producer responsibility as of January 1, 2009. Manufacturers of televisions, computer monitors, desktop and laptops computers, are required to join the standard plan or create an independent plan to manage their equivalent share of collected products. West Virginia
Governor Manchin approved SB 746 (Facemyer) in April 1, 2008. This bill requires manufacturers to develop recycling programs and implement take back programs by July 1, 2009. Manufacturers pay registration fees into a state fund, which is used to reimburse counties and municipalities for recycling programs and administrative costs. WV already had many regional and city recycling programs in place prior to the passage of SB 746. All manufactures of computers, monitors, televisions and video display devices 4" or larger must register with the WV Department of Environmental Protection (DEP) by January 1, 2009. Manufactures who market covered electronic devices in West Virginia are required to pay a registration fee, to set up a take-back program, (either through a mail in program, a collection events program or a collection center) and to pay a yearly fee. Both manufactures and retailers are penalized for selling goods in the state without proper manufacture registration. All fees, fines and penalties are to be deposited into the "Covered Electronic Devices Take back Fund," which will be administered by the Secretary of the DEP and used for recycling grants for counties and municipalities for recycling and other programs that divert covered electronic devices from West Virginia's waste stream. SB 398 was signed into law on March 20, 2010. This law prohibits landfill disposal of televisions, monitors, and computers as of January 2011. West Virginia is the 15th state to enact a statewide landfill ban or disposal prohibition that covers one or more electronic devices. Wisconsin
Wisconsin's electronics recycling law establishes a statewide program, now called E-Cycle Wisconsin, to collect and recycle certain electronics. It is based on a product stewardship approach, which assigns primary responsibility for collection and recycling to the manufacturer. The law also bans certain electronics from Wisconsin landfills and incinerators after Sept. 1, 2010. The law establishes requirements for manufacturers, recyclers and collectors to ensure that recycling is done in an environmentally sound manner.
